The District Court heard Greenland processed bulk letter drops as stamped mail to collect the maximum commission, before sending the material out with no stamps attached.
Judge John Williams said the evidence of the fraud was “anything but clear” and put the actual figure stolen at a maximum $70,000.
“I am not satisfied that the Crown has established beyond reasonable doubt the ($1.38 million) stated,’’ he said.
Greenland admitted the theft, but claimed he only sent mail out without stamps for a 10-week period in 2009 resulting in a much smaller fraud.
Judge Williams said the licensee had reasonably become aggrieved when he learnt Australia Post was undercutting his business and poaching many of his best, corporate clients.
“What seems to be apparent is that the postal business is a fairly cut-throat business,” he said.
“It is not my place to comment, but postal operations generally would benefit with the sort of inquiry that an organisation like (the Independent Commission Against Corruption) can conduct.”

THE post office licensee who scammed Australia Post through fake stamp sales has escaped jail after a judge declared the organisation could use a corruption investigation.
The licensee of the historic Millers Point post office, Tim Alexander Greenland, was this afternoon given a two-year good behaviour bond for stealing from the government corporation.The 46-year-old was initially accused of stealing $4.2 million, but this figure was later reduced to about $1.38 million over an eight-year period.
